One key difference between Collaborative Law and traditional
divorce is the pledge by the clients and the lawyers to reach an agreement
without going to court.
We have found that the
collaborative process increases the role of the clients in reaching their own
agreement and avoids the necessity of having the course of their family's
future determined by strangers.
The Collaborative Law process relies on establishing open communication
and mutual respect as well as placing special emphasis on the needs of the
children and the post separation lives of the parties.
We find that when the parties
decide not to give control of their lives to the judicial system they have more
energy to direct towards creating a settlement that works for the entire
family.
Of course we will continue to
practice the traditional model and will always seek to maximize client
involvement and satisfaction.
